Terms and conditions of sale

We invite online customers using our site who purchase flowers to read the following general terms of sale carefully before ordering any of the products shown on this internet site. Acquiring a product through the present site implies an unreserved acceptance by the purchaser of the present terms and conditions of sale.

Item 1: The Products

The Coté Fleurs online shop allows you to create the bouquet of your choice by following the different steps proposed. Every step is illustrated with photos of floral arrangements relating to your choices. These pictures are intended to be informative examples, and to give you some ideas to help you create a floral arrangement which closely matches your wishes. The floral creations that you will achieve will not be identical to the photos on the site. Flowers are a natural perishable product that can vary with the seasons so we need to be flexible; every creation is unique. The florists at Coté Fleurs are highly qualified and creative; they will create an arrangement that matches your requirements as closely as possible. We assume that the purchaser agrees with this process for creating “Coté Fleurs online” bouquets and, due to this, we will not accept any claim relating to the examples shown on the site.

Item 2: Sales Conditions

So that the floral arrangement that you have chosen is made under the best conditions, the order must arrive with us in the day before if you want a delivery the following morning, and in the morning before 1pm for a delivery the same afternoon. You can also place an order for same day delivery but, in this case, you must telephone the team at Coté Fleurs to make sure that they are able to process your order. If you do not do this, Coté Fleurs will treat the order in the normal way, either the morning after for orders placed the previous day or in the afternoon for orders placed before 1pm. All orders placed in the afternoon without a phone call will be delivered the next day. We would like to remind you that orders for destinations not shown in the delivery table (for example in the canton of Vaud) must be placed 2 days in advance. If you have a special request (for example a large number of flowers of the same variety) we urge you to place the order several days in advance so that we can meet your wishes. As soon as we have received your order, you will get an email confirming that we are able to treat it on time. If this is not the case, then we will contact you by email or telephone in order to propose an alternative.

Item 3: The Deliveries

We only deliver in Switzerland. Your flowers are delivered by Coté Fleurs SA to the address indicated in the order. If the delivery is far away, we may telephone before delivering to make sure that somebody will be there during the time slot. We never reveal the name of the sender, so that it is always a surprise when the card is opened. If we have not been able to confirm the delivery with the recipient, we will contact you without delay. If we are not able to contact you, the order is put on hold and eventually cancelled without charge after a few days. The delivery charges are calculated using the reference table of distance based on the post code of the destination. If you would like a destination not shown in the reference table, then this is also possible, but it will be undertaken by a business partner, which is why it is necessary to give two days notice to organise this. In every case, we are committed to respect the delivery date, but not necessarily a specific time. Our experienced drivers will endeavour to choose the best time slot indicated in the order or convenient to the recipient, according to the delivery schedule and the prevailing traffic conditions. We deliver according to the following timetable: Monday, Tuesday, Wednesday Thursday, Friday, from 8am to 6pm, Saturday from 8am to 1pm. We deliver every day except Sunday. The shop is open all year apart from the annual holidays from December 24th to January 10th, during the Easter weekend (closing Thursday 5pm, reopening Tuesday 8am) and during the official holidays (Thursday for Ascension, Monday for Pentecôte, August 1st and Thursday Jeûne Genevois). During busy times such as Valentine’s Day, Mother’s Day, Jewish New Year and December 24th, it is particularly important to respect the deadlines so that we can organise the delivery of your order. If Mother’s Day, December 24th or the Jewish New Year falls on a Sunday, then we only carry out deliveries in the morning.

Item 4: Accuracy of data

So that we can respect our liabilities, we request that you complete the obligatory fields of the order carefully and accurately. If data is not correct, we will not be able to process your order and it will be suspended until we are able to contact you. If we are not able to contact you, the order will be put on hold and subsequently cancelled after a few days. In this case, we do not guarantee a full refund.

Item 5: Price and Payment

We execute the orders according to the budget that you define, and this is shown without VAT. The delivery prices indicated are also shown without VAT. The rate of VAT is related to the products ordered. The rate of VAT is 2.5% for cut flowers, orchids, funeral wreathes and arrangements providing that the price of the containers does not exceed 30% of the total value. We are committed to ensuring that the price of the container does not exceed 30% of the value of the arrangement so that a rate of 2.5% can apply. The delivery charges are linked to the flowers and are also charged at 2.5%. An 8% rate of VAT applies to containers and other packaged products supplied.

The orders processed by the e-business Coté Fleurs are only accepted with a payment by credit card via the Postfinance secure payment platform. The site lets you pay in both Swiss Francs and in Euros. The rate of exchange used is the one existing at the time of the transaction with Postfinance.

Item 6: Quality of the Products

We buy our products daily from trustworthy suppliers who are able to provide top quality and freshness. Flowers have a lifespan which varies with the variety. An arrangement of cut flowers generally lasts one week under normal conditions of temperature and maintenance and an arrangement of orchids between one and two months. We cannot be held responsible for periods of high temperature or cases when common sense is ignored such as leaving a bouquet without water for several hours, exposing the flowers to temperatures below 10°C, leaving the flowers exposed in full sun, or choosing a vase that is too small and contains insufficient water for them to thrive.

Item 7: Guarantees

We endeavour to guarantee good quality, however flowers are perishable natural products, and it can happen that that there is a poor bloom despite our best efforts. In this case, we ask you to advise us within 3 days by sending an email to info@cotefleurs.ch with a photo of the damaged arrangement. Alternatively, you can also return the bouquet directly to the shop. Excluding heatwaves, and providing that the flowers have been looked after sensibly, we will undertake to replace them. If there is any doubt about the origin of the bouquet photographed, or its maintenance, Coté Fleurs reserves the right to ask the customer to return it to the shop before replacing it. In the case of a gift, if the recipient of the flowers is not satisfied for subjective reasons or preferences, we are unable to carry out a replacement or give any kind of cash refund or credit. However, we always respect the choice of the sender.

Item 8: Cancellation

All orders may be cancelled up to 48 hours before the delivery date. In this case, the customer must advise us by telephone on 0041 22 347 97 47 or by email to info@cotefleurs.ch. If this lead time is not respected, we will not be able to accept the cancellation unless there are exceptional circumstances. Providing that the correct notice has been given, charges will be refunded.

Item 9: Privacy

All data stored in the ordering system is confidential. It will only be used to process your order and will not be passed on to third parties for mailings or advertising. We reserve the right to send you some communications from time to time to keep you updated on our activities. You can opt out of these mailings if you wish. You can also delete your customer account by sending an email to info@cotefleurs.ch.

Item 10: Place of Jurisdiction

The Company Coté Fleurs SA respects the Swiss law and applies it to the scope of its activity. The place of jurisdiction is Geneva.

Item 11: Intellectual Property

The intellectual property rights of all graphics, photos, text and comments on the site and the e-business of Coté Fleurs SA are subject to worldwide copyright. Any total or partial reproduction of the site’s contents is therefore strictly forbidden.

Item 12: Opening Hours
